Company tax residence, the source of profits and treaty entitlement are separate concepts. A Hong Kong incorporation certificate can be relevant to residence, but does not answer every question arising from management and operations abroad.
Identify the purpose A bank's tax residency declaration, a treaty relief claim and a profits source analysis serve different purposes. Read the specific form or rule instead of reusing one answer automatically across all three.
Understand the resident status certificate The IRD issues certificates for relevant double taxation agreement purposes where requirements are met. Applicants must consider the applicable treaty definition and provide the requested information.
The IRD notes that issuing the certificate does not guarantee relief from the treaty partner. Other treaty conditions and the partner's assessment still matter.
Consider management abroad Where important decisions are made outside Hong Kong, another jurisdiction may apply its own residence or taxable presence rules. A founder running the company from home should explain that reality to advisers in both relevant places.
Keep a factual management record Document who makes decisions, where they act and the company's actual operations. Do not create artificial minutes claiming meetings occurred somewhere they did not.
Before seeking a certificate or claiming benefits, identify the payment, treaty article, period and supporting facts. This produces a targeted analysis rather than treating residence as a badge that automatically eliminates foreign tax.
